The petitioner seeks bail in Atri P.S. Case No. 55 of 2016 registered for the offence punishable under Sections 304(B), 201, 504, 506/34 of the Indian Penal Code. Informant is the father of the deceased who in his written complaint has stated that his daughter was married to Pankaj Rajbanshi two years before and at the time of marriage presents and cash were given to her in-Laws.

It has been submitted that there is general and omnibus allegation of demand of dowry and torture against all the family members. It has been further submitted that the petitioner came to learn about the incident on 24.03.2016. It has been submitted on behalf of the petitioner that he is innocent

Patna High Court Cr.Misc. No.35009 of 2018(4) dt.16-08-2018 2/2 and has been falsely implicated in this case. There is no specific allegation against the petitioner. It has been further submitted that on the date of occurrence petitioner was not at the place of occurrence but was in Hatkhola (West Bengal) to earn his livelihood and he is residing separately from the family of the deceased. Petitioner has got no criminal antecedent and is in custody since 19.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd, Gaya, in connection with Atri P.S.
