Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Bibhutipur P.S. Case No. 60 of 2023 registered for the offences under Section 341, 323, 325, 354-A, 354B, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the instant case. Further submission is that there is case and

Patna High Court CR. MISC. No.43238 of 2023(2) dt.04-08-2023 2/2 counter case between the parties. Both the parties have sustained injuries in the alleged occurrence. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M. Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 60 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
