This is an application for bail in connection with Jehanabad P.S.Case No. 319 of 2016 registered under Section 366A of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR but later on it is alleged that the victim girl has informed her friend on phone about the petitioner and thereafter the name of the petitioner transpires in this case. However, the statement of the friend of the victim girl, namely Anjali Kumari, has been recorded during investigation and in paragraph-17 of the case diary she has stated about the love affairs of the victim girl and the petitioner and when it has come to the knowledge of the victim girl that the petitioner is a married
Patna High Court Cr.Misc. No.48837 of 2016 (4) dt.25-01-2017 2/2 person she has turned around and except that there is no allegation against the petitioner. It is further submitted that there is delay of three days in lodging the FIR and the petitioner is in custody for more than six months.

Having heard learned counsel for both sides and considering the statement of Anjali Kumari, the friend of the victim girl and also considering the fact that the petitioner is in custody for more than six months, let the petitioner, Ram Vinay Singh, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jahanabad, in connection with Jehanabad P.S.Case No. 319 of 2016, subject to the conditions that one of the bailors should be a local one and further he will co-operate in the trial and make himself available before the court on the dates fixed and in the event of failure on his part to appear before the court on two consecutive dates, his bail bond shall be liable to be cancelled.
