Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016. Huge quantity of whisky was recovered from a truck and the petitioner was also travelling on the same truck. Petitioner has got criminal antecedent of identical nature. Submission is that petitioner is in custody since 16.04.2019. He is a labour. He has just taken lift to go to his destination.

Considering the entire facts, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

No.38567 of 2019(4) dt.25-09-2019 2/2 two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahua Police Station Case No.216 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

The learned Trial Court is directed to expedite the framing of the charge if needed after separating the trial of the petitioner.
