2. The petitioner seeks regular bail in connection with Katihar (Sahayak) P.S. Case No. 302/2023 lodged on 24.04.2023 under Sections 25(1-B) a, 26 of the Arms Act, 1959.
3. As per the prosecution case, recovery of one pistol has been made from the possession of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner has committed no offence and he has been falsely roped in this case. From the First Information Report itself it appears that no live cartridges have been recovered from the possession of the petitioner and without live cartridges, the pistol has no use. He further submits that the petitioner is in custody since 25.04.2023 having no criminal antecedent.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar, in connection with Katihar (Sahayak) P.S. Case No. 302 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C. (Dr. Anshuman, J) Ashwini/- U T
