2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(4) of the BNS and under Section 27 of the Arms Act.
3. The case of the prosecution is that while the informant was driving his sand loaded truck along with codriver towards Saran. He was intervened by one Scorpio having no number plate. It is also alleged that three unknown miscreants came out of the Scorpio and assaulted with fists and slaps. It is further alleged that two round firing was also made by the miscreants after which informant and conductor fled away. It is further alleged that altogether Rs.19,300/- cash and two mobile phones were looted by unknown miscreants.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.40965 of 2025(3) dt.20-08-2025 2/2 that the FIR was lodged against unknown miscreants. During investigation, his name has surfaced in this case as a mobile was recovered from his house. It has been submitted by the learned counsel for the petitioner that there is no statement of any of the witnesses or informant that this mobile belongs to them. No TIP of the mobile has been conducted. The petitioner is having criminal antecedent of one case in which he is on bail. The petitioner is in judicial custody since 12.04.2025.
5. Learned APP for the State has vehemently opposed the bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kopa P.S. Case No. 72 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Saran at Chapra.
