The petitioner seeks bail in Islampur P.S. Case No.80 of 2016 registered under section 302/34 IPC.
The brother of the deceased lodged the case alleging that on the previous day there was a quarrel between the family of the petitioner and the deceased whereafter they held out threats. On the date of occurrence the deceased, as usual, had gone to Islampur but did not return. On the following day, his dead body was found deserted on the road. It is alleged that while travelling back home he was assaulted by the accused persons. Although there is no eye-witnesses to the occurrence but the witnesses
Patna High Court Cr.Misc. No.38248 of 2016 (5) dt.10-11-2016 2/2 examined in the case have supported about the quarrel which had taken place the previous evening between the deceased and the petitioner whereafter there was threat given by the petitioner. Apart from this, it appears that the petitioner has some criminal antecedents.
It is stated that the petitioner is in custody since 18.04.2016 and there is no eye-witnesses to the occurrence. Having considered the submissions of the parties and on perusal of the material on records, this Court, for the present, is not inclined to extend him the privilege of bail.
