The petitioner seeks bail in connection with Giriyak P.S. Case No. 117 of 2018, registered under Sections 379, 461 and 411 of the Indian Penal Code and Section 25(1b)a, 26/35 of the Arms Act. The accusation is that on 23.03.2018, informant being the Officer-in-Charge of O.P. Pawapuri (Giriyak) Police Station received information at about 10.00 P.M. to the effect that some persons are engaged in breaking the lock of shop of Kalyan Jwellers in Pawapuri market. Thereafter, he along with other Police officials reached there, where three persons were apprehended in suspicious condition, who disclosed their names as Gautam Kumar, Mantu Vishwakarma and Ravi

Patna High Court Cr.Misc. No.34459 of 2018(4) dt.02-08-2018 2/2 Kumar and soon thereafter four persons, including the petitioner, were also apprehended there.

Learned counsel for the petitioner submits that, in fact, petitioner had gone in relation in Pawapuri market, but he was also apprehended by the Police mere on suspicion. Further submission is that petitioner has no criminal antecedent and he is in custody since 26.03.2018. Further submission is that coaccused Vikash Kumar, who is said to have apprehended on the spot has already been enlarged on bail on 13.06.2018 passed in Criminal Miscellaneous No. 34112 of 2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-I, Biharsharif, Nalanda in connection with Giriyak P.S. Case No. 117 of 2018.
