Petitioner, already in custody, seeks bail in connection with Jadiya P.S. Case No.15 of 2018, registered under Section 392 of the Indian Penal Code.

Allegation is that some unknown miscreants looted cash of Rs.1,39,800/- and mobile from the informant. Learned counsel for the petitioner submits that the FIR is against unknown, merely on the basis of recovery of the looted mobile, the petitioner has been made accused though he has no criminal antecedent and the mobile, as per his confessional statement, he had received from his maternal nephew, so the petitioner had no knowledge about the mobile being robbed one and has remained in custody for last three

Patna High Court Cr.Misc. No.34573 of 2018(4) dt.02-08-2018 2/2 months approximately and the petitioner was also not put on TIP.

Having considered the aforesaid facts and circumstances, petitioner Kailash Kumar Mehta is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 5th, Supaul in connection with Jadiya P.S. Case No.15 of 2018.
