This revision application has been filed against the order dated 13.01.2011 passed by the 1st Additional Sessions Judge, Gopalganj, in Cr. Revision No.579 of 2010 by which he has set aside part of the order dated 09.09.2008 by which the Chief Judicial Magistrate, Gopalganj, had directed in Kuchaikote P.S. Case No.137 of 1994 that Protest-cum-Complaint Petition be treated as Complaint Petition.

Considering that the Revisional Court has passed the order in violation of the established procedure, this application is allowed and the Chief Judicial Magistrate, Gopalganj, is directed to proceed in accordance with law without being prejudiced by the stray observation of the superior Court.
