JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code and and under sections 3⁄4 of the Dowry Prohibition Act.

As per the prosecution case, the petitioner and his family members subjected the daughter of the informant to cruelty and harassment and they killed her for non-fulfilment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is mother-in-law of the deceased and lives separately. There is general and omnibus allegation of making cruelty and harassment against all the accused persons and no

Petitioner is in custody since 18.9.2020. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Banka in Amarpur Police Station Case No. 579 of 2020.
