JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 20-08-2016 The facts are not convincing enough that the petitioner who is almost 68 years of age still has a minor child in whose name she is claiming family pension. Obviously, this is an effort to beget the benefit after law does not allow payment of family pension to the second wife who married the employee during the life time of the first wife.
Such cock and bull story cannot form the basis for grant of any relief in favour of the petitioner. The Court, therefore, will not pass any order in favour of the petitioner. Let her establish such a fact
Patna High Court CWJC No.18164 of 2014 dt.20-08-2016 2 / 2 and get a declaration from a civil court before she can get any benefit of such kind.
