The application is for grant of bail in connection with Kurtha PS case no. 119/2016 for the offence under Sections 304B, 201 of the Indian Penal Code.
It is submitted on behalf of petitioner that no specific allegation has been attributed against the petitioner and on the way to hospital, the deceased died. It is further submitted that petitioner himself surrendered on 20.09.2016. Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and submit that there are allegation of harassment and torture as well as demand of dowry and disposal of the dead body without post mortem. It is further submitted that petitioner is the husband of deceased.
Patna High Court Cr.Misc. No.54726 of 2016 (3) dt.16-01-2017 2/2 Having heard both sides. Considering the fact that petitioner is the husband of the deceased and he had tortured the deceased for demand of dowry, I am not inclined to grant bail to the petitioner. As such, his prayer for bail rejected. However, lower court is directed to expedite the trial. With these observations, this bail application is dismissed.
