The petitioner prays for grant of bail in Khirhar P.S. Case No. 34 of 2013 registered under sections 302 and 201 IPC. The Chaukidar found the dead body near a pond/river and lodged the case against unknown. In course of investigation, it revealed that the deceased was one of the two wives of one Satyanarayan who was quarreling every day.

So far as petitioner is concerned, it is submitted that only material to suspect his implication is that he (petitioner) used to visit the house of the deceased every now and then. It is stated that the petitioner is in custody since 26.06.2016 and the charge sheet has already been submitted. There is no criminal background

Let the petitioner, named above, in the facts and circumstances of the case, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri A. K. Pandey, Judicial Magistrate 1st Class, Madhubani in Khirhar P.S. Case No. 34 of 2013 (G.R.No.1596 of 2013) on condition that one of the bailors shall be his own/close family member. He shall continue to appear in person on each and every date fixed at the trial. In case he fails to appear on two consecutive dates without any compelling reason, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
