Petitioners being mother and married sister of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 326, 307, 120B of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The prosecution case is that the victim was married with one Md. Firoj but after one month of the marriage she was being tortured for non-fulfilment of dowry demand. It is further alleged that on 06.04.2015 the informant's husband and petitioner No. 2 caught hold the informant when father of the husband sprinkled kerosene oil and petitioner No. 1 being mother of the husband lit fire. Subsequently the victim succumbed to the injuries.

No.37768 of 2015 (2) dt.22-09-2015 2/2 It is submitted by learned counsel for the petitioners that the victim got accidental burn injury and to wreak vengeance the informant has named the petitioners. Moreover the husband of the victim is in custody. Considering the nature of accusation, let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Habibpur P.S. Case No. 31 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Bhagalpur.
Accordingly the application is disposed of.
