The petitioner seeks bail in Matihani P.S. case No. 61/2016 registered under Sections 450, 354(B), 379, 341, 323 of the Indian Penal Code.
The informant alleged that a thief entered into his house, committed theft of ornaments worth rupees one lac and cash of rupees fifteen thousand. The niece of the informant was sleeping in the same room and when she woke up, the informant pressed her mouth and tried to outrage her modesty but, on alarm, the informant saw the petitioner fleeing away from the place of occurrence.
Learned counsel for the petitioner submits that the petitioner is a neighbour of the informant. On the next day, the petitioner was apprehended from his house but nothing has been
Patna High Court Cr.Misc. No.38300 of 2016 (3) dt.22-11-2016 2/2 recovered from the possession of the petitioner. The petitioner has already remained in jail for more than five months and he has got no criminal antecedent.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pushpendra Pandey, Judicial Magistrate 1st Class, Begusarai in Matihani P.S. Case No. 61 of 2016.
