The petitioner being the daughter of the informant is languishing in custody since 24.06.2016 in a case registered for the offences punishable under sections 498A, 341, 307, 494, 347, 323 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand, assault and performing second marriage. Learned counsel for the petitioner submits that the petitioner admits his marriage with the informant and he is ready to keep her as wife with full dignity and honour. A statement to that effect has been made in para 11 of the petition which reads as follows:-
Patna High Court Cr.Misc. No.45216 of 2016 (2) dt.25-10-2016 2/2 "That the petitioner is ready to keep the informant's daughter with full honour and dignity as his wife." It is further submitted that the investigation has already concluded.
Considering the nature of accusation and the investigation being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria, in connection with Maheshkhunt P.S. Case No.53/2016.
