The petitioner apprehends his arrest in Excise Case No.291 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The Sub-Inspector of Excise recovered liquor from the abandoned house of labour situated near a stone crushing machine and the witnesses disclosed that the petitioner and Chinku Yadav were seen throwing the bags containing liquor. The learned counsel for the petitioner submits that the petitioner has got no manner of concern with the recovered liquor. Petitioner has got no criminal antecedent. The recovery was made from a lonely place.

Taking into consideration the facts aforesaid, let the

No.40167 of 2019(2) dt.01-07-2019 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II-cum-Spl. Judge, Excise, Rohtas, Sasaram in connection with Excise Case No.291 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
