Petitioner seeks bail in a case registered for the offences punishable under Sections 363,376,511,120B/34 of the Indian Penal Code and 4/6/7/8/12/17/18 POCSO Act. Three person named in the FIR attempted to ravish the complainant a minor girl. Out of three person, coaccused-Santosh faced trial which resulted in acquittal and on that reason, another co-accused-Sonelal has been granted bail by the learned court below. Petitioner is in custody since 16.05.2018.
Considering the nature of allegation and period already undergone as well as other material discussed above, let the petitioner, above named, be released on bail on furnishing
Patna High Court CR. MISC. No.39382 of 2019(2) dt.27-06-2019 2/2 bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tr.No.74 of 2018 arising out of Piar Police Station Case No.148 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
