1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 307, 379 and 504 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and from perusal of the allegation as alleged in the F.I.R., it would manifest that Ram Vishwas Yadav assaulted Lal Babu Mahto by an iron rod causing injury on head. Thereafter, Nandan Kumar assaulted Sonu Kushwaha with rod causing injury on lips and further, snatched chain of Sonu and Amit Kumar took Samsung mobile and Rs.6,000/-.

4. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation is alleged against the petitioner.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in connection with Palanwa P. S. Case No.34 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
