The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,324,307 and 379/34 of the Indian Penal Code. The prosecution case is that co accused Md. Neyaz, Md. Ghochu and petitioner and three four unknown surrounded the informant. The petitioner and Md. Neyaz assaulted the informant with iron rod on head and others assaulted with fists and slaps. It is further alleged that co accused Ghochu snatched four thousand five hundred rupees and gold chain from the informant. It is submitted by the learned counsel for the petitioner that from the FIR it does not appear that any substantial

Patna High Court Cr.Misc. No.37290 of 2015 (2) dt.15-09-2015 2/2 injury was caused to the informant and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Khajekala P.S. Case No. 295 of 2014 pending in the court of learned CJM, Patna.

This application is disposed of with the aforesaid observation/direction.
