02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30A of the Prohibition of Bihar Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 35 litres toddy has been recovered from the auto rickshaw which was being boarded by four persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 19.03.2017.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.32402 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Patna City, Patna in connection with Chauk P.S. Case No. 61 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
