2. The petitioner seeks regular bail in connection with Birpur P.S. Case No. 324 of 2024 registered for the offence under Sections 140(3), 140(1), 3(5) of the B.N.S.
3. As per the prosecution case, the informant has alleged that the petitioner along with other co-accused persons have kidnapped and killed the husband of the informant for the demand of ransom. The name of the petitioner has transpired on the confessional statement of the co-accused.
4. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. He has also submitted that one coaccused has been granted privilege of bail by a Co-ordinate
Patna High Court CR. MISC. No.42707 of 2026(2) dt.09-07-2026 2/2 Bench of this Court vide order dated 12.09.2025 passed in Cr. Misc. No. 32891 of 2025.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioner.
7. Accordingly, this application for regular bail is hereby rejected.
8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
