JUSTICE SATYAVRAT VERMA ORAL ORDER 07-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Supaul P.S. Case No. 886 of 2020, instituted for the offences under Sections 25(1-b) and 26 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 31.12.2020, charge-sheet has been submitted and the allegation is of recovery of loaded countrymade pistol from the possession of the petitioner. The learned counsel for the petitioner further submits that the petitioner has been falsely implicated in the present case. Nothing was recovered from his possession. The learned A.P.P. vehemently opposes the bail application and submits that the petitioner has got four cases.

No.51231 of 2021(2) dt.07-02-2022 2/2 Considering the fact the petitioner is in custody since 31.12.2020, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V (A.C.J.M.-V), Supaul, in connection with Supaul P.S. Case No. 886 of 2020, with a condition that one of the bailor shall be the father of the petitioner.

The application stands allowed.
