This appeal is under the provisions of Section 14A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against the order of refusal of regular bail by the learned Additional Sessions Judge III-cum-Special Judge, Muzaffarpur, in connection with Minapur P.S. Case No. 349 of 2015 (G.R. No. 4886 of 2015), registered under Sections 323, 341, 504, 420 and 406 of the Indian Penal Code and 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The first information report reveals that the occurrence of assault and abuse took place for land dispute between the parties. The appellant is in custody since 02.09.2016. Considering the nature of allegation and period already undergone by the appellant, above named, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Minapur P.S. Case No. 349 of 2015 (G.R. No. 4886 of 2015) to the satisfaction of the Additional Sessions Judge III-cum-Special Judge, Muzaffarpur, or successor Court. This appeal stands allowed.
