The petitioner seeks bail in a case registered under Sections 379, 414 of the Indian Penal Code.
Allegation is that the accused persons took away Rs.1970/- from the pocket of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.02.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against co-accused, namely, Soni Kumari. The petitioner is said to have assisted the said co-accused in committing the alleged occurrence. Co.-
Patna High Court CR. MISC. No.38353 of 2019(2) dt.25-06-2019 2/2 accused Soni Kumari has been granted bail vide Annexure2 to the present application by a co-ordinate Bench of this Court. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st-cum-Sub Judge, Muzaffarpur in connection with Kazi Mohammadpur P.S. case No.71 of 2019.
