1. Heard learned counsel for the petitioner and learned APP for the State.

2. Petitioner seeks regular bail in connection with Complaint Case No. 391 of 2021, dated 06.03.2021 registered for the offences punishable under Section 498(A) of the Indian Penal Code.

3. The main submissions advanced by learned counsel Mr. Sachin Kumar appearing for the petitioner are that the petitioner is the husband of the complainant and the instant matter is based on complaint filed by the complainant who has not made any allegation of physical cruelty against this

Patna High Court CR. MISC. No.44923 of 2023(2) dt.27-07-2023 2/2 petitioner. Further submission is that the petitioner has been languishing in jail since 21.02.2023 having fair and clean antecedent.

4. Learned APP Mr. Narsingh Tanti appearing for the State has opposed the prayer for bail.

5. Having regard to the facts and circumstances of this case, considering the above submissions and mainly petitioner's custody period and the nature of allegation appearing against him, this Court is inclined to accept the prayer for bail of the petitioner. Accordingly, let the petitioner namedabove be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Complaint Case No. 391 of 2021.
