JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414, 120B of the Indian Penal Code and Sections 30(a), 32(2), 35(a), 38(i), 41(i) of the Bihar Prohibition and Excise Act, 2016.
Earlier, the prayer for bail of the petitioner was rejected by this court, vide order, dated 17.01.2019 passed in Cr. Misc No. 179 of 2019 but submission on behalf of the petitioner is that the petitioner is languishing in jail custody since 29.07.2018. It is further submitted that the petitioner does not have any criminal antecedent and, as a matter of fact, petitioner was khalasi of the truck, from which, the alleged recovery was

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularity taking note of period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Vaishali at Hajipur in connection with Sarai P. S. Case No. 164 of 2018, subject to condition that one of the sureties must be close relative of the petitioner who shall swear an affidavit to this effect, as to how, he/she is related with the petitioner. The bailors may submit the documents of property situated outside the state.
