The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the three accused persons including the petitioner herein threatened the son of the informant that he would be killed on coming out of his house. It is stated that at about 6 pm co-accused Naitullah called the son of the informant who went with him and thereafter did not return. Subsequently, the dead body of the son of the informant was found in an agricultural filed near the house of the petitioner.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.50609 of 2021(3) dt.29-03-2022 2/2 that the petitioner has been falsely implicated in the case based on an unfounded suspicion. There is no eye-witness to the occurrence. The petitioner is in custody since 20.12.2020 and charge sheet has been submitted in the case. Co-accused Naitullah has been enlarged on bail vide order dated 21.3.2022 passed in Cr. Misc. no. 48604 of 2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year and grant of bail to the above named co-accused Naitullah, the Court directs the petitioner to be enlarged on bail in connection with S.Tr. Case no. 340 of 2021 (arising out of Shikarpur P.S. Case no. 687 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-IV, Bettiah, (West Champaran).
