2. The petitioners are apprehending their arrest in connection with Rasulpur P.S. Case No. 243 of 2024 registered under Sections 80(2) & 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per allegation, the allegation against the petitioners is of strangulating the Informant's sister to death for non-fulfillment of dowry demand.
4. Learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.41491 of 2025(4) dt.03-12-2025 2/3 that the petitioners are innocent and have falsely been implicated in the present case. He further submits that the petitioners are in-laws of the deceased. The petitioner no.1 is the sister-in-law of the deceased whereas petitioner nos. 3 & 4 are Nanad and mother-in-law of the deceased. The petitioner no.2 is the husband of petitioner no.1. The petitioners have no concern with the day-to-day affairs of the deceased. Learned counsel for the petitioners further submits that as a matter of fact, the couple were quarreling for some trivial issues and the petitioners have no concern with that quarrel. By drawing attention of this Court to paragraph nos. 12 and 13 of the case diary, which contains the statement of the independent witnesses, learned counsel for the petitioners submits that the witnesses Anil Kumar Singh and Raju Kumar Singh have stated that the marriage of the deceased was solemnized on 18.12.2022 and after marriage, the couple started quarreling.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail
Patna High Court CR. MISC. No.41491 of 2025(4) dt.03-12-2025 3/3 bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra, in connection with Rasulpur P.S. Case No. 243 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the B.N.S.S., 2023.
7. The petitioners will appear in the court below on each and every date fixed by the learned trial court till framing of the charges.
