This is a petition for grant of regular bail in connection with Pupri P.S. Case No. 431 of 2017 for offences under Sections 363, 366, 366A and 370 of the Indian Penal Code.
Accusation is that the petitioner had kidnapped away the minor daughter of the informant with assistance of his family members.
The contention of the learned counsel for the petitioner is that the girl of the informant was major. She herself declared her age 181⁄2 years, the Court has assessed her age 19 years moreover during investigation it also transpired that both were reading in the same school and talking with each other as per the
Patna High Court Cr.Misc. No.31756 of 2018(5) dt.03-08-2018 2/2 call records of mobile and both belong to different communities, so the girl after returning back has changed her statement, but, there is no accusation of any physical or sexual assault by the petitioner.
Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Pupri P.S. Case No. 431 of 2017 to the satisfaction of the Subdivisional Judicial Magistrate, Pupri, Sitamarhi.
