2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30 (a), 32(3), 41(1) and 41(2) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 2060 liters of spirit was recovered from seized vehicles.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of seized vehicle. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the prayer for bail.

Considering the aforesaid facts, clean antecedent of petitioner and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, Excise-II, Aurangabad in connection with Excise P.S. Case No. 388 of 2026, subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023.
