The petitioner seeks bail in Chakai P.S. Case No. 155 of 2009 registered for the offence punishable under Sections 414, 120B, 121/34 of the Indian Penal Code and Sections 3/4/5 of the Explosives Substances Act and Section 10/10(B)/13 of the Unlawful Activities, Prevention Act and Section 17 of the C.L.A Act.
Allegation against the petitioners are of recovery of 10 bags of explosives from their house.
It has been submitted that during the course of trial similarly situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 20.04.2018
Patna High Court Cr.Misc. No.31579 of 2018(4) dt.13-08-2018 2/2 passed in Criminal Miscellaneous No. 23036 of 2018, dated 04.05.2015 in Cr. Appeal (S.J.) No. 171 of 2015, dated 16.06.2011 in Criminal Miscellaneous No.18831 of 2011, dated 21.04.2011 in Criminal Miscellaneous No. 10577 of 2011, dated 30.03.2011 in Criminal Miscellaneous No. 9181 of 2011, dated 07.03.2011 in Criminal Miscellaneous No. 31824 of 2010. Petitioners are in custody since 24.11.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui, in connection with S.T. No. 452 of 2010 and S.T. No. 763 of 2010 arising out of Chakai P.S. Case No. 155 of 2009.
