This is a petition for grant of regular bail for offence under Sections 395 and 397 of the Indian Penal Code. Some unknown person committed robbery of bolero jeep of the informant.

Submission of the petitioner is that the petitioner was apparently arrested on suspicion and, thereafter, his confessional statement recorded. Further statement is that similarly situated coaccused, Upendra Rai, and others have already been allowed bail by a coordinate Bench of this Court.

The petitioner has filed supplementary affidavit to show that pervious cases against the petitioners were also lodged against unknown and name of the petitioner appeared in the confessional statement of the co-accused. In one of the cases petitioner has already been acquitted.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 500 of 2016

Patna High Court Cr.Misc. No.53217 of 2016 (4) dt.11-01-2017 arising out of Ramgarhwa P.S. Case No. 13 of 2016 to the satisfaction of the Additional Sessions Judge, II, East Champaran at Motihari, or successor Court.
