Petitioner is languishing in judicial custody since 23.03.2017 in connection with Civil Line P.S. Case No. 72 of 2016 registered for the offence punishable under Sections 356 and 379 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was returning home and talking on his mobile to his mother, two persons came on a motorcycle and snatched away his mobile, which occurrence has been seen by the people on the road. It has been submitted by the learned counsel for the petitioner that he is not named in the First Information Report, bears no criminal antecedent and the mobile has not been
Patna High Court Cr.Misc. No.26020 of 2017 (2) dt.04-07-2017 2/2 recovered from the possession of the petitioner. In fact, petitioner's father owns a jewellery shop and some jewellery was purchased by the informant's father for which money was not paid and the petitioner was demanding the money, as such, he has been falsely implicated in the aforesaid case. He submits that chargesheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Incharge Chief Judicial Magistrate, Gaya in connection with Civil Line P.S. Case No. 72 of 2016.
