ANJANA MISHRA ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 286 of 2013 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Diary of the present case was called for, which has since been received.

Learned counsel for the petitioner submits that vague and general allegation has been levelled against the petitioner, who is the sister-in-law (SALI) of the deceased, is said to have been killed. The allegation is that wife of the deceased had developed illicit relationship and as a consequence thereof, the

Learned counsel for the State after perusing the case diary submits that save and except the allegation made in the FIR, there is no cogent material to implicate the petitioner with the aforesaid offence.

Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case no. 286 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
