2. The petitioner seeks pre-arrest bail in connection with Bettiah Town P.S. Case No. 88 of 2024 registered for the offence(s) punishable under Section 379 of the Indian Penal Code.

3. As per the allegation made in the FIR, the petitioner has stolen motorcycle bearing Registration No.BR22A10642.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner has been made accused in the present case because he is accused in two cases also lodged in connection with theft of motorcycle. Learned counsel further

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Having considered the rival submissions made on behalf of the the parties, as well as, the fact that information has been given to this Court that petitioner has undertaken that he will not involve in criminal activities in future, I find it proper that petitioner may file his undertaking before the District Court at the time of submission of bail bond.

7. In case, such affidavit is filed on the date petitioner surrenders, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No. 88 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

8. It is made clear that the petitioner will make his attendance before the concerned police station under which his

No.44766 of 2024(2) dt.24-07-2024 3/3 house is located every day at 10:00 a.m. till conclusion of the trial and on any single default without any valid reasons on the part of the petitioner, his bail bonds shall be cancelled and the concerned SHO of the police station shall submit his monthly attendance report to the Superintendent of Police having jurisdiction.
