The petitioner seeks bail in Maheshkhunt P. S. Case No. 09 of 2019 instituted for the offence under Section(s) 364A of the Indian Penal Code.

Learned counsel for petitioner submits that husband of informant is not traceless. Learned counsel further submits that from the order of Sessions Judge it would appear that husband of informant is in custody in connection with Maheshkhunt P.S. case no. 12 of 2019 due to forgery and cheating. It has further been submitted that husband of informant was a LIC agent and he was involved in wrong practice and habitual to commit criminal offence. Maheshkhunt P.S. case no.12 of 2019 has been lodged against him for issuing a policy in the name of person who was already dead and after

Learned counsel for the petitioner has further submitted that informant and petitioner are close relatives. The victim is son of maternal uncle of petitioner. Victim is a LIC agent through which petitioner had taken a policy. Prior to alleged occurrence victim had taken the amount of premium for depositing against the policy. After sometime petitioner came to know that premium was not deposited then he made pressure to refund the said amount. Thereafter the instant case has been filed by wife of victim against the petitioner.

Petitioner is in custody since 25.1.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1st Class, Khagaria, in connection with Maheshkhunt P. S. Case No. 09 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
