The petitioner seeks bail in Goraul P.S. Case No. 374/2015, registered for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code.

The informant got information that Md. Aftab uses to sell stolen motorcycles and on such raid was conducted. On the disclosure of Md. Aftab, eight stolen motorcycles were recovered by the side of a canal. One stolen motorcycle was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in jail since 28.12.2015. The petitioner has already remained in jail for more than one year. Of course, the petitioner has got criminal antecedent but similarly situated co-accused

Patna High Court Cr.Misc. No.54448 of 2016 (2) dt.10-01-2017 2/2 persons has already been enlarged on bail.

Considering the facts aforesaid and the fact that the petitioner is in jail for the last thirteen months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 374/2015.
