The petitioner seeks bail in a case registered under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner is of committing torture and caused death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-11-2018. Charge sheet has already been submitted. The house of the petitioner was caught fire and the deceased had sustained burn injuries, which led to her death. The informant has made an application before the

Patna High Court CR. MISC. No.38103 of 2019(3) dt.15-07-2019 2/2 court below vide Annexure-2 to the present application where he has retracted from his earlier statement made in the FIR. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Sare P.S. Case No. 140 of 2017.
