Petitioners seek regular bail in connection with Chautham P.S. Case No.23 of 2017 registered for the alleged offences under Sections 147, 148, 149, 342 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, the petitioner along with other accused persons started resorting firing upon the husband of the informant when he was irrigating the field. Pandav Yadav fired from rifle which caused injury upon the mouth of the husband of the informant.
It has been submitted by learned counsel for the petitioner that the petitioner happens to be member of the mob.
Patna High Court Cr.Misc. No.31002 of 2017 (02) dt.06-07-2017 2/2 The allegation of firing is against the Pandav Yadv and the deceased has sustained one injury. He has been falsely implicated in this case. This case has been filed after 35 days of alleged date of occurrence and is a counterblast of Chautham P.S. Case No.10 of 2017 lodged against the husband of the informant and others. He has been languishing in jail custody since 19.05.2017. In the facts and circumstances of the case, the petitioners above named are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned A.C.J.M.-II, Khagaria in connection with Chautham P.S. Case No.23 of 2017.
