ANJANA MISHRA ORAL ORDER 06-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 17.03.2018 in connection with Charpokhari P.S. Case No.67 of 2018 registered for the offence under Sections 366A and 347 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire story is concocted and the allegation that this petitioner, who is the father of the accused Ajeet Kumar, and other brothers had participated in the occurrence of kidnapping of the victim girl is altogether false and fabricated. It is further submitted that the victim girl was recovered and she had given her statement on 16.03.2018 and on the same day, the petitioner

Patna High Court Cr.Misc. No.32237 of 2018 (4) dt.06-08-2018 2/2 was arrested from his village home. Though the victim girl has alleged that all the accused persons were responsible for the kidnapping, the girl was, however, recovered from Delhi, which goes to show the falsity of the statement of the victim girl regarding the involvement of the present petitioner. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-10, Bhojpur at Ara, in connection with Charpokhari P.S. Case No.67 of 2018.
