29-11-2021 Heard learned counsel for the parties.

Petitioners pray for grant of bail in Hayaghat P.S. Case No. 85 of 2021, registered for the offence under Section 304(B) / 34 of the Indian Penal Code.

As per the F.I.R., this petitioner alongwith other F.I.R. named persons committed torture and caused death of the daughter of the informant due to non-fulfillment of demand of dowry.

Petitioner no. 1 is father-in-law and petitioner no. 2 is cousin father-in-law of the deceased. There is general and omnibus allegation. The thrust of the allegation is against coaccused Raman Kumar, who is husband of the deceased, and presently, is in custody. Petitioners were living separately from

Patna High Court CR. MISC. No.51062 of 2021(2) dt.29-11-2021 2/2 the deceased and no specific overt act has been alleged against them. Petitioners are in custody since 19.06.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Darbhanga in connection with Hayaghat P.S. Case No. 85 of 2021.
