The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30A, 35A, 38(1)(2) and 42(2) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, about 90 litres of foreign liquor were recovered from a Maruti car. It is further contended that petitioner was not apprehended from the spot rather it is claimed that he has been implicated on the basis of confessional statement made by the persons who have been apprehend with liquor from the said Maruit car saying that the petitioner is owner. Such persons have already been granted

Patna High Court Cr.Misc. No.36223 of 2017(2) dt.10-08-2017 2/2 bail by a co-ordinate Bench of this Court vide order dated 10.07.2017 passed in Criminal Miscellaneous No.30651 of 2017. Petitioner claims that he is having clean antecedent and is in custody since 10.05.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-VI, Samastipur in connection with Vidyapati Nagar P.S. Case No. 58 of 2017.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
