JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 387/427/435/34 of the Indian Penal Code and Section 17 of the C.L.A Act.

The tractor of the informant was burnt by unknown miscreants. The petitioner was apprehended on suspicion and confessed before the police his guilt. The impugned order reveals that the learned Court-below perused the case-diary and only material which was considered for refusal of the bail is the criminal antecedent of the petitioner.

Submission of the learned counsel for the petitioner is that in most of the past criminal cases the F.I.R. is

There is no other material to compel the petitioner to remain in jail custody as under trial prisoner. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Sherghati P.S. Case No.25 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
