Petitioner seeks bail in Jainagar P.S. Case No. 35 of 2017 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Informant in his fardbeyan has alleged that on 08.02.2017 at about 7:00 am, he alongwith his uncle Alam Khan was standing near his Taylor shop. His uncle was opening the shutter of the shop then Satan Jha and others arrived and in the meantime three unknown criminals two of them armed with Carbine and one was having country made pistol, started indiscriminate firing which hit Alam Khan in his stomach and hand and he got seriously injured and the informant alongwith

Patna High Court Cr.Misc. No.33487 of 2018(5) dt.30-08-2018 2/2 Satan Jha fled away to save themselves and thereafter the miscreants went away.

It has been submitted on behalf of the petitioner that his name has surfaced in this case on the basis of confessional statement of co-accused Shatrughan Yadav who confessed the name of Rohit Yadav and Ranjit Mahto for committing the killing and allegation against petitioner is that he prepared plan to kill Satan Jha from jail. He confessed that he along with Rohit Yadav made a plan to eliminate Satan Jha and Nand Yadav. Except the said confessional statement there is no incriminating material against the petitioner to implicate him in this case. According to confessional statement Satan Jha was not killed. Petitioner is in custody since 06.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned SDJM, Madhubani, in connection with Jainagar P.S. Case No. 35 of 2017. (S. Kumar, J) ranjan/- U
