The petitioners seek bail in anticipation of their arrest in connection with Raniganj P.S. Case No. 295 of 2020, dated 11.06.2020, instituted for the offences under Sections 147, 148, 149, 269, 270, 271, 341, 323, 307,

Patna High Court CR. MISC. No.38080 of 2020(2) dt.16-04-2021 2/3 332, 353, 427 and 431 of the Indian Penal Code. A young girl was killed in a road accident and for that, the villagers had congregated on road and had disturbed the free-flow of the traffic. The police party also was attacked.

It appears from the impugned order as well as from the bail application that about twenty four persons have been named in the F.I.R. and about fifty persons have been made accused as unnamed. The accusation against all the accused persons is general and omnibus. It further appears from the bail application that the petitioners were not present in the crowd when the occurrence is said to have taken place.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial

Patna High Court CR. MISC. No.38080 of 2020(2) dt.16-04-2021 3/3 Magistrate, Araria in connection with Raniganj P.S. Case No. 295 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

Since the order has been passed in the absence of the counsel for the petitioners, it is not known whether the petitioners have been arrested or not. This order therefore shall be given effect to only if the petitioners have not been arrested up-till now.

The application stands allowed.
