Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
It is alleged that a truck loaded with stone chips were intercepted when it was being taken away from the police premises. The constables on the duty suggested that they saw the petitioner and his driver taking away the vehicle in question.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The petitioner is no way connected with the seized truck rather petitioner is practicing advocate. Considering the suspicious nature of
Patna High Court Cr.Misc. No.36164 of 2015 (2) dt.08-09-2015 2/2 accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Dehri(T) P.S. Case No. 263 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Dehrion-sone, Rohtas. With the observations above, the application stands disposed off.
