JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 328, 120(B) of the Indian Penal Code. It would appear from perusal of the written report that the relation of the deceased with her husband, was not cordial and prior to her death, the deceased had lodged Chandramandih P.S. Case No. 92 of 2010 as well as Jamua P.S. Case No. 260 of 2010 against her husband and other in-laws but due to amicable settlement, the deceased went to her in laws' house and subsequently, it is alleged that she was administered poison. It is also alleged that in the life-time of the deceased, her husband had solemnized his second marriage with co-accused Reshmi Devi. The petitioner happens to be father of co-accused Reshmi Devi

Patna High Court Cr.Misc. No.42526 of 2016 (2) dt.06-10-2016 2/2 and submission on his behalf is that he resides separately from in laws of the deceased and moreover, except suspicion, there is nothing against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chandramandih P.S. Case No. 28 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jamui.
