====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 13-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Kotwali P.S. Case No. 122 of 2018 registered for the offences punishable under Sections 401/34 of Indian Penal Code and Sections 25(1-b) A, 26/35 of Arms Act. Informant is the Police Officer, who in his written complaint has stated that on 27.02.2018 at about 5:30 P.M., when he was on patrolling duty, he got an information that some miscreants have assembled to commit some major crime and after the said information when he reached at the place of occurrence then out of four, three miscreants fled away and petitioner was caught and upon search of his person a country made pistol was recovered from his possession.

No.30729 of 2018(4) dt.13-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case and nothing was recovered from his possession. In Para-3 of the petition one antecedent has been reported against petitioner on being involved in a case under Sections 395 and 412 of Indian Penal Code in the year 2007. Petitioner is in custody since 28.02.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 122 of 2018.
